A total of 4952 Zimbabwean nationals have been deported since 01 January 2012. Due to the voluminous amount of research which must be undertaken by the Department of Home Affairs to provide the specific information , it would require a considerable amount of time to be researched. The solemnisation and registration of civil marriages, customary marriages and civil unions are managed by the Department of Home Affairs. Civil marriages are governed by the Marriage Act and regulations issued in terms of the Act. South Africa also recognizes customary marriages through the Recognition of Customary Marriages Act, which became effective in November 2000. Civil unions are recognised in terms of the Civil Union Act . The provisions of this article pertaining to the granting of the licenses before a marriage can be lawfully celebrated apply to all persons who assume the marriage relation in accordance with subdivision four of section eleven of this chapter. Nothing in this article contained shall be construed to render void by reason of a failure to procure a marriage license any marriage solemnized between persons of full age.
Home Affairs allows secular marriage officers to register

A magistrate, additional magistrate, assistant magistrate, shall by virtue of his office and as long as he holds such office be a marriage officer for the district or area in respect of which he holds such office.
Each town and city clerk hereby empowered to issue marriage licenses shall keep a book supplied by the state department of health in which such clerk shall record and index such information as is required therein, which book shall be kept and preserved as a part of the public records of his or her office. Whenever an application is made for a search of such records in the city of New York, the city clerk of the city of New York may make such search and furnish a certificate of the result to the applicant upon the payment of a fee of five dollars for a search of one year and a further fee of one dollar for the second year for which search is requested and fifty cents each additional year thereafter. All such affidavits, statements and consents, immediately upon the taking or receiving of the same by the town or city clerk, shall be recorded and indexed as provided herein and shall be public records and open to public inspection whenever the same may be necessary or required for judicial or other proper purposes. Such clerk shall not be required to file any of said documents with the state department of health until the license is returned with the certificate showing that the marriage to which they refer has been actually performed.
Marriage Officers in Cape Town & Western Cape
Notwithstanding the provisions of section eleven of this article or any other law, the governing body of any village, town, or city may appoint one or more marriage officers who shall have the authority to solemnize a marriage which marriage shall be valid if performed in accordance with other provisions of law. Nothing herein contained shall nullify the authority of other persons authorized to solemnize marriages. The number of such marriage officers appointed for a municipality shall be determined by the governing body of the municipality. Such marriage officers shall be eighteen years of age or over, and they shall reside in the municipality by which they are appointed.
Officials from the Department of Home Affairs had discussions with the British High Commission in May 2012 to re-open negotiations in respect of visa arrangements between the Republic of South Africa and the United Kingdom. At the meeting, the officials from the High Commission requested to be engaged again in this matter after the Olympic Games were held inLondon. This usually requires that one of the couple attend home affairs in person. However some Marriage Officers have a good enough relationship with their office that they can make the appointment on your behalf. This is especially helpful in cases where the couple in question live abroad.
§ 5Incestuous And Void Marriages
Although there is no restriction on the number of customary marriages that a man may enter into, no further customary marriage may be entered into unless an order of court regulating the future matrimonial property system of his marriages has been obtained. In South Africa, the definition of a customary marriage is one that is “negotiated, celebrated or concluded according to any of the systems of indigenous African customary law which exist in South Africa”. This does not include marriages concluded in accordance with Hindu, Muslim or other religious rites. Marriage, so far as its validity in law is concerned, continues to be a civil contract, to which the consent of parties capable in law of making a contract is essential. The Department of Home Affairs is in the process of retrieving the necessary information in respect of the year 2000 until present.
This can be done at any office of the Department of Home Affairs or through a designated traditional leader in areas where there are no Home Affairs offices. The marriage officer must then submit the marriage register to the nearest office of the Department of Home Affairs, where the marriage details will be recorded in the National Population Register . Each office has their own schedule of which days they do marriages. The fact that there is no cost involved in getting married through the Department of Home Affairs is the only advantage unfortunately. Up until approximately 2002 you could go to court and be married by a Magistrate.

The purpose of the pilot roll-out is to ensure that the Smart ID card meets the expectations of South African citizens and to inform them that the Smart ID card is of high quality, built-in international security features and that it will be user friendly. This pilot process provides external stakeholders with an opportunity to ask for the inclusion of any additional useful information to the benefit of the citizens of South Africa. It is therefore another method of final testing to get to a final product. The pilot will thus be issued at no cost to the identified individuals.
Customary marriages are registered by completing BI-1699 and paying the required fees. An acknowledgement of receipt BI-1700 will then be issued by the Department. The organisation’s first two marriage officers are currently completing the certification process. Raubenheimer said that although this was not the first time that a secular group had been allowed to sponsor marriage officers in South Africa this remained unusual. He added that the process for Home Affairs to accredit SASS had not been an easy or quick one, and that the group initially faced some resistance. Any such clergymen or officer as aforesaid to whom any such license duly issued may come and not having personal knowledge of the incompetency of either party therein named to contract matrimony, may lawfully solemnize matrimony between them.
This has resulted in many offices refuses to assist same sex couples. This is untenable and in late 2018 regulations were issued stating that Home Affairs were no longer allowed to turn away same sex couples. Now, eligible SASS members can apply to the department to become legally certified marriage officers under the banner of the organisation. A marriage that is otherwise valid shall be valid regardless of whether the parties to the marriage are of the same or different sex.
Visits to Border Posts are also undertaken by the Department from time to time. No processes have been put in place yet for the collection and amalgamation of information and data from other Departments. It will only take place once the Department of Home Affairs has engaged with all the Departments who indicate that they wish to have their information included into the Card.
Every office has at least one designated Marriage Officer. This is most often a secondary role in that it is not his person’s primary duty to conduct marriages. A marriage officer is a person who is permitted by South African law to marry couples, same-sex or heterosexual, in accordance with the Civil Union Act. The law below are the relevant statutes relating to who can solemnize marriage and officiant registration in New York .
In addition to getting consent from the parents or guardian, boys under the age of 18 and girls under the age of 16 may also be required to seek the consent of the Minister of Home Affairs. The Minister may, on application, condone a marriage which required his/her consent but was contracted without such consent. If a parent whose consent is legally required but either cannot be found to grant consent, or is legally incompetent to do so, then an application may be made to a Commissioner of Child Welfare for consent to the marriage.
If the person fails the examination, his / her denomination may request that the person re-writes the examination. In some states, you and your partner can legally marry yourself without the need for a third party acting in the capacity of wedding officiant to sign your marriage license. To solemnize means to observe or honor with solemnity, or to perform with pomp or ceremony.
